I live in Ms. and bought a trailer from someone in Al. which does not require a trailer to be titled but Ms. does.I am the 4th owner.Seems the 2nd owner didnt want to pay sales tax so he never transfered the title.Well now i want to sell the trailer but cant in Ms. unless i have a title.All i got was a bill of sale when i bought it from the 3rd owner.I have tracked down the 2nd owner and he siad he was not going to pay sales tax on a trailer he doesnt own and will not give up the old title.With late fees and such its costly at this point.Am i stuck with this trailer????

Ya know, if the guy with the title gives you the signed title from it's first owner, he shouldn't have to pay sales tax. The only way he'd have to pay sales tax would be if he went and had the title changed to his name. I think he's not thinking clear or he's trying to extort money out of you by lying about how much it's going to cost him to give you the title.
How do I know this. I took a trailer to an auction for a friend of mine that he never had the title transfered. As far as the DMV knows or even cares, the last person on the title sold you the trailer.
Otherwise, contact the DMV for the state it will be registered in and ask them what needs to be done to title a trailer with a bill of sale. I know it can be done, but don't know how many hoops they will make you and/or the purchaser jump through to do so.

Does the title have the second owners info entered on it?  If not he doesn't have to do anything.  If it does and he won't give it up call the local DMV and ask what is the best way to go about it.  

My dad had this problem YEARS ago in Tx and went to a tiltle company, had them research the title/vin for any records then with his bill of sale they were able to retitle the trailer.

In Ohio we don't have titles, either. I do have the original Certificate of Origin for my trailer, but I don't even have to produce that. I think on trailers that weight more than a certain amount, one might have to have a title, but on smaller ones, none needed. This could provide a problem selling it out of state if I chose to do so.

I sold a trailer a few months ago that I had owned for 4 years without changing the title. I had to find the previous owners and have them sign the title over to me. I then signed it over to some people from Missouri. I didn't pay any sales tax and neither did the other people. The people from MO. have to have a title so they will have to pay tax.I now have a trailer from N.C. and I am debating on whether to change the name on the title or not. It is a lot less hassle if you sell it out of state but property taxes have to be paid on it each year if the title is changed.

You can sell a trailer in Ms. without a title. Its probably not the most prefered way to do business but you can do it. I purchased one (with bank money)with only a bill of sale and sold it to a gentelman who also borrowed from the bank to purchase it from me, with the bank accepting the bill of sale as sufficient. Like I said , this is not the preffered method but it does work, or at least it did for me!

There are no property taxes on horse trailers in Kentucky, No tags either, so there is no real advantage to putting the trailer in your name or disadvantages either. If you do title it you will get a notice in the mail every year saying that you still own it until it is transfered out of your name. Little bit of a nuisance, I don't have the trailer I own now in my name but do have a signed title for it from Ohio.

In Alabama, the 2nd owner would not have to pay sales tax to transfer the title.  He can go to his county tag office and just pay to transfer the title.  All he has to do is tell them he is not using the trailer and never did.  I paid just $18 to have my trailer titled for the lienholder but have not paid the sales tax on it, and don't plan to.  You could offer to pay the $18 for him and he wouldn't be out any money.

In Missouri - I've experienced two "no title" issues.

1)  I purchased a trailer from OK which does not require trailer titles.  A state patrol officer had to come to my MO residence and run a stolen vehicle check.  I was then able to apply for a MO title for the trailer.

2)  Purchased a really used trailer that was titled two owner's back.  MO would require that I pay sales taxes and yearly lisc fees from last paid.  Ending up it would cost more than I paid for the trailer.  So you could revert to option 1 and just say it had no title.

Maybe you can check with your DMV and get a abandoned title on it.

I typed a whole bunch and when it posted it all went away!!!

I licensed my wife's two-horse CM Playday trailer w/o title as it weighed less than 2000 pounds empty.  I could not find title at the time - but I just had to get it weighed and got my farm tags on it...$8.30.

I declared a previous owner as deceased once at DMV on a trailer I bought with no title and they typed a new title up for me right then and there.DMV said we can only help if the old owner is deceased.Then handed me a form to read and sign! Thanks DMV.

Thanks for all the advice.I think i will just try to sell it without a title.May not get as much as i want for it.Most people around here dont have $10,000 without going to the bank and im sure a bank would want a title.But its worth a shot.

In TN it will have to be actually titled in each and every persons name that is on the back of it. The back of it is for assignment by dealers only. Once it gets past two folks, a real pain to clear up. And getting expensive.

DMV here in Georgia said if he's DEAD then we issue a new title.You USE this form.I filled it out and handed it back.they said you sure he's DEAD.I sad YUP.Had a title in less then 10 minutes.Kept trailer another year or so and sold it no worrys.That was more then 15 years ago.Actually the guy was in jail I think in another state.To me thats as good as dead.
